Terms of Service

These Terms of Service ("Terms") govern your access to and use of the POC.ai platform, website, CLI tools, APIs, and related services (collectively, the "Service") provided by PsyTech, Inc. ("POC.ai," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you confirm that you are at least 18 years old and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not use the Service.

2. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your account credentials and API keys
• Promptly notify us of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

• Use the Service to deploy applications that violate any applicable law or regulation
• Attempt to gain unauthorized access to the Service, other accounts, or related systems
• Use the Service to distribute malware, conduct phishing attacks, or engage in any malicious activity
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any portion of the Service
• Resell, sublicense, or redistribute the Service without our prior written consent
• Use the Service to mine cryptocurrency or run compute-intensive workloads unrelated to application deployment

We reserve the right to remove any deployment or suspend any account that violates these terms, with or without prior notice.

4. Service Description

POC.ai provides a platform for deploying, previewing, and managing applications, with a focus on safely deploying AI-generated code. The Service includes, but is not limited to:

• Automated framework detection and build pipelines
• Preview and production deployment environments
• A command-line interface (CLI) and web dashboard
• APIs for programmatic access and integration
• Monitoring, logging, and deployment management tools

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify you of material changes in advance.

5. Intellectual Property

Your Content. You retain all rights to the code, data, and content you deploy through the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to process Your Content solely for the purpose of providing the Service to you.

Our Service. The Service, including its design, features, documentation, and underlying technology, is owned by PsyTech, Inc. and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand assets without our prior written consent.

6. Payment Terms

Certain features of the Service require a paid subscription. By subscribing to a paid plan, you agree to:

• Pay all applicable fees as described on our Pricing page
• Provide valid and current payment information
• Accept that subscriptions renew automatically at the end of each billing period unless cancelled

All fees are non-refundable except as required by law or as expressly stated in these Terms. We may change our pricing with 30 days' prior notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

If payment fails, we may suspend your account after providing reasonable notice and an opportunity to update your payment method.

7. Limitation of Liability

To the maximum extent permitted by applicable law, PsyTech, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, revenue, business opportunities, or goodwill, arising out of or related to your use of the Service, regardless of whether such damages were foreseeable and whether we were advised of the possibility of such damages.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Termination

You may terminate your account at any time by contacting us or through your account settings. Upon termination:

• Your right to access the Service will cease immediately
• Active deployments will be taken offline within 24 hours
• We will delete your data in accordance with our Privacy Policy

We may terminate or suspend your account immediately, without prior notice, if we determine that you have violated these Terms, engaged in fraudulent or illegal activity, or if required to do so by law.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware. You consent to personal jurisdiction and venue in these courts.

10. Changes to Terms

We may revise these Terms from time to time. When we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service.
